Due Process Rights, Data Privacy and Other Student Rights

The technical assistance documents found on this page address due process rights – rights provided during the special education process to the parents of students with disabilities. Technical assistance documents provide guidance on data privacy, which addresses who has the right to access student information contained in student education records.

The rights provided to general and special education students in the area of instruction during illness or injury and due process rights provided to special education students after their 18th birthday are addressed in additional technical assistance documents.
